5. Products and Services ("All Sales Final" & Condition) Certain products or services may be available exclusively online through the website or exclusively in-store. These products or services may have limited quantities.

 

  • All Sales Final: Due to the nature of our wholesale and closeout inventory, all sales are strictly final. We do not accept returns, process refunds, or allow exchanges.

  • Product Condition: We frequently sell "Scratch and Dent," "Open Box," or "Blemished" merchandise. These items are sold strictly "AS-IS" regarding their physical and cosmetic appearance. By purchasing these items, you acknowledge and accept these pre-existing cosmetic conditions.

  • Display: We have made every effort to display as accurately as possible the colors and images of our products. We cannot guarantee that your computer monitor's display of any color will be accurate.

6. Shipping, Delivery, and Risk of Loss All items purchased from Wholesalers Unlimited USA, LLC are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the freight carrier or parcel carrier (FOB Origin).

  • We are not legally or financially liable for items that are lost, stolen, or damaged in transit.

  • It is the customer's strict responsibility to inspect all LTL freight deliveries prior to signing the Bill of Lading, as outlined in our Return & Refund Policy. Failure to note damage upon delivery legally releases the carrier from liability and voids any applicable transit insurance.

7. Accuracy of Billing and Account Information We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.

8. Limitation of Liability and Warranties Wholesalers Unlimited USA, LLC does not directly warranty any products. Any applicable mechanical warranties are provided strictly by the original manufacturer. In no case shall Wholesalers Unlimited USA, LLC, our directors, officers, employees, affiliates, agents, contractors, or suppliers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, arising from your use of any of the service or any products procured using the service.

Indemnification You agree to indemnify, defend and hold harmless Wholesalers Unlimited USA, LLC and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
